Information on the right to return pursuant to Legislative Decree No. 21/2014 implementing Directive 2011/83/EU on consumer rights, amending Directives 93/13/EEC and 1999/44/EC and repealing Directives 85/577/EEC and 97/7/EC.
The Consumer is acknowledged the right to withdraw from the concluded contract, without any penalty, due to a change of mind, within the term of 14 (fourteen) days starting from the day on which the Consumer receives the product. In order to exercise the right of withdrawal, the Consumer is obliged to inform the Seller of his decision to withdraw from the contract by means of an explicit declaration, which shall be assessed by the Customer Service. Within the following 14 days, the Consumer must return the Products to the Seller, by sending or delivering them to Ambrosia Trade, Palatucci 6 - 25015 Desenzano del Garda (BS) Italy, clearly indicating the relative return code/order number. The risks and transport costs relating to the return of the Products to the Seller shall be borne by the Consumer.
In order for the right of withdrawal to be validly exercised, the Products must be delivered, or sent to the Seller, intact and unused/unassembled, otherwise a return request cannot be accepted. The Products must be returned in their original packaging and must be sent to the Seller in a single shipment. Once it has been verified that the products have been returned in the conditions described above, the Seller will proceed to issue the refund agreed between the Consumer and the Seller.
The Seller may withhold such refund until it has received the Products (and the verification of the returned Products has been successful).
In the event that the request to withdraw from the contract occurs due to a proven non-conformity of the Products, the Consumer must contact Customer Service, via the platform, providing an adequate description of what was found and all the detailed photographic material (relating to the packaging and the product) necessary for Customer Service to take charge. Any refunds will be issued only after appropriate evaluations and verifications. The Products must be delivered, or sent to the Seller, undamaged and unused/missing, otherwise a return request cannot be accepted.
The Products must be returned in their original packaging and must be sent to the Seller in a single shipment. Once it has been verified that the products have been returned in the conditions described above, the Seller shall proceed to issue the refund agreed between the Consumer and the Seller.
The Seller shall reimburse the Consumer for the total amount paid by the latter, including delivery costs (with the exception of additional costs deriving from the possible choice by the Consumer of a type of delivery other than the least expensive type of standard delivery offered by the Seller).
In the event of a request for cancellation due to a change of mind or error on the part of the Consumer, the latter shall promptly notify the Seller of this decision. If the order has not yet been entrusted to the carrier, the cancellation and refund of the order shall be made. Conversely, if the order has already been entrusted to the courier, it will not be possible to cancel the order. In this case, the consumer will have to refuse the delivery and will only be reimbursed the cost of the product and not the shipping costs.
The refund will be made once it has been verified that the products have been returned to the sender/warehouse in their original packaging, undamaged, unassembled and unused.
It is not possible to make changes to the delivery address communicated in the order. Should there be any kind of error, it is however important to communicate this via messaging. The seller will attempt to communicate the new address to the courier, but delivery to the new address is not guaranteed.
In the event that delivery is unsuccessful, the order will be returned to the sender, in which case only the value of the product will be refunded - shipping costs to the customer and return shipping costs will not be refunded. If the shipping costs were free of charge, however, a flat rate will be deducted based on the amount of the price paid, according to the following table:
The order placed will be delivered to the address indicated by the Consumer according to the methods communicated at the time of ordering, except in the event of product unavailability or force majeure.
The delivery terms, communicated in the order phase, must be considered indicative, not essential and not binding for the Seller.
In the event that delivery is made within the time interval indicated on the platform at the time of purchase, but the addressee is absent, delivery will be retried on the first subsequent working day. If the second delivery attempt is also unsuccessful due to the absence of the consumer, the goods will remain in stock. Our Customer Service will contact the consumer to arrange a new delivery. In the event of no response or a further failed delivery due to absence of the addressee, the package will be returned to the sender. In this case, the Seller will proceed to refund the amount paid, but a fixed amount will be deducted based on the amount of the order, related to the cost of the return returned to the sender for non-delivery. If the Consumer still wishes to receive the product again, he must place a new order.
Upon receipt of the products at the consumer's home, the consumer must check that the products are intact and correspond in quantity to the order confirmation.
In the event of discrepancies or discrepancies in the delivery due to partial delivery or visibly damaged products/packaging, the Consumer must notify the Carrier of the anomaly by accepting with reservation or refusing the delivery and promptly inform Customer Services.
In the event of visible damage to the product packaging during delivery, the Consumer must refuse the delivery or request the Carrier to take back the package by writing RESERVATION FOR DAMAGED PACKAGE or specifying the type of damage; the mere wording RESERVATION OF CHECK will not be sufficient to obtain a refund for the order. Failure to accept with reservation will not entitle you to a refund.
